These general terms apply to Maleny Cuisine promotions, discount codes, free-delivery offers, complimentary gifts and social-media campaigns unless specific offer terms state otherwise.
Maleny Cuisine is a brand owned and operated by Niora Foods Pty Ltd. In this policy, “Maleny Cuisine”, “we”, “us” and “our” refer to Niora Foods Pty Ltd in connection with the Maleny Cuisine brand, website and online store.
1. General application
A promotion is also subject to any dates, eligibility rules, product exclusions, redemption instructions, limits and special conditions displayed with the offer. If specific offer terms conflict with these general terms, the specific terms apply to the extent of the conflict.
2. Free delivery over $60
Standard delivery is free for an eligible retail order delivered to one Australian address where the merchandise subtotal is $60 or more after discounts and before shipping. The offer does not apply to wholesale orders, multiple address deliveries, excluded products or services, or any destination the website identifies as ineligible. Unless stated otherwise, it cannot be exchanged for cash or applied retrospectively.
3. Discount codes
• A code must be entered correctly at checkout before payment and within the stated promotional period. • Only one code may be used per order unless the offer expressly allows combination.
• A code may be limited to specified customers, products, quantities, order values, channels or delivery regions.
• Codes are not transferable, redeemable for cash or available for resale unless expressly stated. • A discount does not apply to delivery charges or gift cards unless expressly stated.
• We may refuse fraudulent, automated, duplicated, unauthorised or abusive redemptions. Failure to enter a code before checkout does not ordinarily entitle a customer to a retrospective discount, although we may assist at our discretion before dispatch. This does not limit rights relating to misleading promotions or other rights under the Australian Consumer Law.
4. Complimentary surprise bottle or sample
Where we offer a complimentary surprise bottle or sample with an eligible purchase, the variety and size are selected by us and are subject to availability. Unless expressly stated, the gift has no cash value, cannot be exchanged, is limited to one per qualifying order and does not count toward the $60 free-delivery threshold. A complimentary food product will include the product information required for its supply. Recipients must read the label, including ingredients, allergens, date markings and storage directions, before consumption. If a recipient cannot safely use the selected gift, they should not consume it. We do not guarantee a particular variety or dietary suitability unless the offer expressly says so.
5. Social-media sharing and tagging
Sharing a photograph or video, posting a review or tagging Maleny Cuisine is appreciated but is voluntary and is not required to receive a complimentary gift included unconditionally with a qualifying purchase. Customers should not make false or misleading claims and should disclose a free product or other material benefit when posting an endorsement where required by advertising standards or law.
A tag does not automatically transfer ownership of content to us. We may interact using ordinary platform functions. We will request permission or rely on a clearly applicable platform licence before using customer content in separate advertising or other off-platform materials.
6. Availability, substitutions and errors
Offers are subject to stock availability and may end when allocated stock is exhausted. We may substitute a complimentary item with an item of reasonably comparable type or value where the offer permits, or omit it if no safe and reasonable substitute is available. We may correct genuine errors or cancel affected redemptions, provided customers are not misled and accepted orders are handled lawfully.
7. Returns and order changes
If a qualifying order is cancelled or returned, any complimentary item may need to be returned unopened or its stated value may be taken into account only where lawful and disclosed. A faulty or damaged promotional item will be handled consistently with the Australian Consumer Law. Shipping and return arrangements are governed by the relevant website policies.
8. Fair participation
We may limit quantities, reject bulk or automated activity and disqualify participation involving fraud, manipulation, technical interference or material breach of offer terms. Decisions will be made reasonably and do not exclude consumer rights.
9. Changes and withdrawal
We may change or withdraw a promotion prospectively where reasonably necessary, including for stock, technical, legal or operational reasons. A change will not remove benefits already confirmed for an accepted order unless required by law or agreed with the customer.
